HotPostcodes provides property data and analytics through our website and API. Our data is sourced from third-party providers including but not limited to HM Land Registry. We process and analyze this data to provide insights, but we do not create or originally collect the underlying property transaction data.

3. Data Accuracy and Limitations

a. Third-Party Data Imperfections: The data we provide is sourced from third-party datasets which may contain inaccuracies, errors, omissions, or may not be current. We cannot guarantee the accuracy, completeness, or timeliness of the data provided through our Services.

b. No Warranty: All data and information provided through our Services is provided "as is" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

c. Use at Your Own Risk: You acknowledge and agree that any use of our data and API services is at your own discretion and risk. You are solely responsible for verifying the accuracy, completeness, and suitability of the data for your intended purpose.

4. Limitation of Liability

a. To the fullest extent permitted by applicable law, HotPostcodes, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content

b. In no event shall HotPostcodes' aggregate liability for all claims relating to the Services exceed the greater of £100 or the amount you paid HotPostcodes, if any, in the past six months for the Services giving rise to the claim.

5. Intellectual Property

a. The Services and their original content, features, and functionality are and will remain the exclusive property of HotPostcodes and its licensors.

b. Our Services may contain data provided by third parties, including HM Land Registry data, which is subject to Crown copyright protection. You are responsible for complying with any applicable copyright notices and license requirements for such third-party data.

6. API Usage

a. API keys are provided at our discretion and may be revoked at any time without notice.

b. You agree not to misuse the API, including through excessive requests, attempts to reverse engineer, or use beyond the scope of what is permitted in your agreement with us.

c. We may impose rate limits or other restrictions on API usage at our sole discretion.

7. Indemnification

You agree to defend, indemnify and hold harmless HotPostcodes and its licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  • Your use and access of the Services
  • Your violation of these Terms
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right
  • Any claims that your use of our data caused damage to a third party

8. No Professional Advice

The information provided through our Services does not constitute financial, legal, real estate, or other professional advice. You should consult with appropriate licensed professionals before making any decisions based on the data we provide.

9. Governing Law
